Welcome to The Foil Edit! The terms "we", "us" and "our" refer to The Foil Edit (trading name of Petite Paperie UK . The Foil Edit operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). The Foil Edit is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (thefoiledit.co.uk/policies/privacy-policy). If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
These Terms are concluded in the English language. Where we are required by applicable law to make these Terms available in the language of an EU member state, we will do so upon request.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or the age of majority in your country of residence if that is higher, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or licence your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services. However, colours or product appearance may differ from how they appear on your screen due to your device type and settings.
We do not warrant that the appearance or quality of any products purchased by you will meet your expectations or be the same as depicted in our online stores.
All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region or jurisdiction.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. The Foil Edit reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until The Foil Edit confirms acceptance.
Please review your order carefully before submitting. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES, TAXES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
Prices are shown in pounds sterling (GBP) unless another currency is expressly displayed at checkout. Product prices do not include shipping, handling, customs charges, import duties, carrier clearance fees or local taxes unless expressly stated at checkout.
For UK customers, applicable taxes and delivery charges will be shown at or before checkout. For customers outside the UK, including customers in the European Union or EEA, the total amount payable to us will be shown at checkout, but local import VAT, customs duties, taxes or carrier clearance charges may still be payable on delivery unless checkout expressly states that these charges have been collected or prepaid by us.
You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are duly authorised to use the chosen payment method, (iii) charges incurred will be honoured by your payment provider, and (iv) you will pay charges at the posted prices including all applicable delivery charges and taxes shown at checkout.
SECTION 5 - EU SALES, IMPORT DUTIES AND CUSTOMS
The Foil Edit is a UK-based seller. Where goods are ordered by customers in the European Union, EEA or Northern Ireland and dispatched from the United Kingdom, the goods may be subject to import procedures in the destination country.
Unless the checkout clearly states that VAT, duties or import charges are included or prepaid, you may be required to pay local VAT, customs duty, handling fees, carrier clearance charges or similar import costs before or at delivery. These charges are set by the destination country or carrier and are not controlled by The Foil Edit.
Customs checks and import processing may delay delivery. Delivery estimates do not include delays caused by customs, local import checks, carrier clearance procedures or events outside our reasonable control.
If a parcel is refused, not collected, or returned to us because import charges were not paid, we may, where permitted by applicable consumer law, deduct from any refund the original delivery charge, return delivery charge, customs charges, carrier charges or other costs actually incurred by us as a result of the refusal or failed delivery.
Nothing in this section limits your mandatory consumer rights under the law of your country of residence.
SECTION 6 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays beyond our reasonable control. All delivery times are estimates only unless we expressly agree a guaranteed delivery date in writing. We are not responsible for delays caused by shipping carriers, customs processing, import checks or events outside our control.
We will deliver goods within the timeframe agreed at the point of purchase, or if no timeframe was agreed, within 30 days. If we fail to deliver within this period, UK customers may be entitled to cancel under the Consumer Rights Act 2015, and EU customers may be entitled to cancel under the EU Consumer Rights Directive (2011/83/EU). Nothing in these Terms affects your statutory rights.
Risk in the goods passes to you when the goods are delivered to you or to a person nominated by you to receive them, unless you arrange your own carrier independently of the delivery options we offer.
SECTION 7 - YOUR STATUTORY RIGHTS (UK CUSTOMERS)
As a consumer based in the United Kingdom, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 that these Terms cannot override.
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. If they are not, you are entitled to a repair, replacement, or refund depending on the circumstances.
Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods without giving a reason. You must inform us within 14 days and return goods within a further 14 days. We will refund the standard delivery cost. You are responsible for return costs unless goods are faulty or mis-described.
Nothing in these Terms of Service is intended to limit or exclude your statutory rights as a consumer under UK law.
SECTION 8 - YOUR STATUTORY RIGHTS (EU CUSTOMERS)
If you are a consumer resident in a European Union member state, you have rights under the EU Consumer Rights Directive (2011/83/EU), Directive (EU) 2019/771 on contracts for the sale of goods, and other applicable EU and national consumer protection legislation. The mandatory consumer protection laws of your country of residence apply to your purchase and these Terms do not override them.
For most online purchases of goods, you have the right to withdraw from your order within 14 days of receiving the goods without giving any reason. To exercise your right of withdrawal, you must inform us by a clear statement, for example by emailing hello@thefoiledit.co.uk, before the withdrawal period expires. You may use the model withdrawal form below, but it is not obligatory.
You must return the goods without undue delay and no later than 14 days after informing us of your withdrawal. We will issue your refund within 14 days of receiving the returned goods or proof of return, whichever is earlier, using the same payment method as your original purchase unless another method is agreed. We will refund the standard delivery cost paid for the original delivery, but not any additional amount paid for a premium delivery method.
You bear the direct cost of returning goods when you withdraw from a purchase, unless the goods are faulty, not as described, or we have agreed otherwise. You are responsible for taking reasonable care of the goods while they are in your possession. Where permitted by law, we may reduce the refund if the value of the goods has been reduced by handling beyond what is necessary to inspect their nature, characteristics and functioning.
The right of withdrawal does not apply to goods that are made to your specifications or clearly personalised, unless they are faulty, not as described, or otherwise do not conform with the contract. This does not affect your statutory rights for faulty or mis-described goods.
EU consumers have a legal guarantee of conformity. Goods must conform with the contract, match the description, be fit for their normal purpose, and have the qualities and features reasonably expected for goods of that type. If goods do not conform, you may be entitled to remedies including repair, replacement, price reduction, or termination of the contract, subject to applicable EU and national law.

SECTION 9 - EU RESPONSIBLE PERSON & GPSR COMPLIANCE
The Foil Edit complies with the EU General Product Safety Regulation (GPSR) (EU) 2023/988 for products sold to customers in the European Union and Northern Ireland on or after 13 December 2024.
In accordance with GPSR, The Foil Edit has appointed an EU Responsible Person to act as the contact point for EU market surveillance authorities. The EU Responsible Person is designated for regulatory and market surveillance purposes only and does not handle consumer queries, returns or complaints.

Product safety technical files and risk assessments are maintained and stored for 10 years in accordance with GPSR requirements. Product listings should also include product safety warnings, manufacturer information, EU Responsible Person information and product identification details where required.
Where required by applicable law, safety warnings and instructions will be provided in a language that can be understood by consumers in the EU country where the product is made available.
SECTION 10 - COMPLAINTS AND ALTERNATIVE DISPUTE RESOLUTION
If you have a complaint about goods or services purchased from The Foil Edit, please contact us first at hello@thefoiledit.co.uk so that we can try to resolve the issue directly.
The European Commission Online Dispute Resolution (ODR) platform has been discontinued and is no longer available for new consumer complaints. EU consumers may be able to obtain information about consumer dispute resolution bodies in their country of residence through the European Commission consumer redress information pages or their national consumer protection authority.
We are not obliged to participate in alternative dispute resolution proceedings unless applicable law requires us to do so, but we will always aim to resolve customer complaints fairly and promptly.
SECTION 11 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, are owned by The Foil Edit, its affiliates or licensors and are protected by UK copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent.
The Foil Edit's names, logos, product and service names, designs, and slogans are trademarks of The Foil Edit or its affiliates or licensors. You must not use such trademarks without the prior written permission of The Foil Edit.
SECTION 12 - OPTIONAL TOOLS
You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind. Any use by you of optional third-party tools is entirely at your own risk and discretion.
SECTION 13 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. If you decide to leave the Services to access third party sites, you do so at your own risk. Complaints regarding third-party products and services should be directed to the third-party.
SECTION 14 - RELATIONSHIP WITH SHOPIFY
The Foil Edit is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with The Foil Edit. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Foil Edit. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Foil Edit.
SECTION 15 - PRIVACY POLICY AND DATA PROTECTION
All personal information we collect through the Services is subject to our Privacy Policy (thefoiledit.co.uk/policies/privacy-policy). By using the Services, you acknowledge that you have read this privacy policy.
We are committed to complying with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR), and the Data Protection Act 2018 in respect of all personal data we collect and process. EU customers' data is processed in accordance with EU GDPR and you have rights including the right to access, rectify, erase, and port your data as set out in our Privacy Policy.
SECTION 16 - FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. You are solely responsible for any Feedback you make and its accuracy.
SECTION 17 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.
SECTION 18 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, national, or local regulations, rules, laws, or ordinances; (c) to infringe upon or violate our intellectual property rights; (d) to harass, abuse, insult, harm, defame or intimidate any of our employees or any other person; (e) to transmit false or misleading information; (f) to send spam, junk mail, chain letters or similar solicitations; (g) to impersonate any other person or entity; or (h) to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.

19.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
19.4 Agents must: (i) identify that requests are from an Agent by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that interactions are from an Agent, including by mimicking human behaviour or bypassing CAPTCHAs; (iii) respond truthfully to any question seeking to determine if interactions are coming from a human or a computer; (iv) not circumvent any measure intended to block, limit, or control how Agents access the Services.
SECTION 20 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 21 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information.
EXCEPT AS EXPRESSLY STATED BY THE FOIL EDIT, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
NOTHING IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS AS A CONSUMER UNDER THE CONSUMER RIGHTS ACT 2015, THE EU CONSUMER RIGHTS DIRECTIVE (2011/83/EU), OR ANY OTHER APPLICABLE NATIONAL OR EU LAW. TO THE EXTENT THAT ANY EXCLUSION OR LIMITATION IN THESE TERMS IS NOT PERMITTED BY APPLICABLE LAW, SUCH EXCLUSION OR LIMITATION SHALL NOT APPLY TO YOU.
SECTION 22 - LIMITATION OF LIABILITY
NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE UK OR EU LAW INCLUDING THE CONSUMER RIGHTS ACT 2015 AND GPSR (EU) 2023/988.
SUBJECT TO THE FOREGOING, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL THE FOIL EDIT, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.
SECTION 23 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless The Foil Edit, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
SECTION 24 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 25 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals between you and us.
SECTION 26 - ASSIGNMENT
You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 27 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. You and The Foil Edit submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising under or in connection with these Terms.
Notwithstanding the above, if you are a consumer resident in a European Union member state, you retain the benefit of any mandatory provisions of the law of your country of residence that cannot be derogated from by agreement. Nothing in this clause affects your rights as a consumer to rely on such mandatory local law protections.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 29 - CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. We will notify you of any material changes to these Terms in accordance with applicable law. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
