Welcome to The Foil Edit! The terms "we", "us" and "our" refer to The Foil Edit (trading name of Petite Paperie UK). The Foil Edit operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). The Foil Edit is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy (thefoiledit.co.uk/policies/privacy-policy). If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

These Terms are concluded in the English language.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or the age of majority in your country of residence if that is higher. You also confirm that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, you may be asked to provide certain information such as your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete.

You are responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or licence your account to any other person.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services. However, colours or product appearance may differ slightly from how they appear on your screen due to your device type and settings.

All descriptions of products are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region or jurisdiction.

Nothing in this section affects your statutory right to receive goods that are of satisfactory quality, fit for purpose and as described.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. The Foil Edit reserves the right to accept or decline your order at its discretion. Your order is not accepted until The Foil Edit confirms acceptance.

Please review your order carefully before submitting. If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email, billing address and/or phone number provided at the time the order was made. If we cancel an order after payment has been taken, we will refund you in full.

Your purchases are subject to return or exchange in accordance with our Return & Refund Policy (thefoiledit.co.uk/policies/refund-policy) and your statutory rights. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

SECTION 4 - PRICES, TAXES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Prices are shown in pounds sterling (GBP) unless another currency is expressly displayed at checkout. All applicable taxes and delivery charges for UK orders will be shown at or before checkout.

For orders delivered outside the United Kingdom, the total amount payable to us will be shown at checkout. However, local import taxes, customs duties or carrier clearance charges may still be payable on delivery unless checkout expressly states that these charges have been collected or prepaid by us.

You represent and warrant that:

1. the payment information you provide is true, correct and complete;
2. you are duly authorised to use the chosen payment method;
3. charges incurred will be honoured by your payment provider; and
4. you will pay charges at the posted prices, including all applicable delivery charges and taxes shown at checkout.

SECTION 5 - INTERNATIONAL ORDERS, IMPORT DUTIES AND CUSTOMS

The Foil Edit is a UK-based seller. We do not currently ship to Northern Ireland or to countries within the European Union.

Where goods are ordered for delivery outside the United Kingdom, they may be subject to import procedures in the destination country. Unless checkout clearly states that taxes, duties or import charges are included or prepaid, you may be required to pay local taxes, customs duty, handling fees, carrier clearance charges or similar import costs before or at delivery. These charges are set by the destination country or carrier and are not controlled by The Foil Edit.

Customs checks and import processing may delay delivery. Delivery estimates do not include delays caused by customs, local import checks, carrier clearance procedures or events outside our reasonable control.

If a parcel is refused, not collected, or returned to us because import charges were not paid, we may, where permitted by applicable consumer law, deduct from any refund the costs actually incurred by us as a result of the refusal or failed delivery.

Nothing in this section limits any mandatory consumer rights under the law of your country of residence.

SECTION 6 - SHIPPING AND DELIVERY

All delivery times are estimates unless we expressly agree a guaranteed delivery date in writing. We are not responsible for delays caused by events outside our reasonable control.

We will deliver goods within the timeframe agreed at the point of purchase or, if no timeframe was agreed, within 30 days. If we fail to do so, you may be entitled to cancel your order and receive a refund under the Consumer Rights Act 2015.

Risk in the goods passes to you when the goods are delivered to you or to a person nominated by you to receive them, unless you arrange your own carrier independently of the delivery options we offer.

SECTION 7 - YOUR STATUTORY RIGHTS

As a consumer, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 that these Terms cannot override.

Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a repair, replacement or refund, depending on the circumstances.

Under the Consumer Contracts Regulations 2013, you generally have the right to cancel your order within 14 days of receiving your goods without giving a reason. You must inform us within 14 days and return the goods within a further 14 days. If you cancel your entire order, we will refund the standard delivery cost. You are responsible for return costs unless the goods are faulty or not as described. Some items, such as genuinely personalised products, are excluded from this right.

Nothing in these Terms of Service is intended to limit or exclude your statutory rights as a consumer.

SECTION 8 - COMPLAINTS

If you have a complaint about goods or services purchased from The Foil Edit, please contact us at hello@thefoiledit.co.uk so that we can try to resolve the issue directly. We will always aim to resolve complaints fairly and promptly.

We are not obliged to participate in alternative dispute resolution proceedings unless the law requires us to do so. If you are not satisfied with our response, you can contact the Citizens Advice consumer helpline for free, impartial advice.

SECTION 9 - INTELLECTUAL PROPERTY

9.1 Ownership
All content on the Services is owned by The Foil Edit or its licensors. This includes our product photography, videos, product descriptions, written content, guides, designs, artwork, packaging, product names, logos, branding, colour and collection names, and the overall look, layout and presentation of our website. It is protected by copyright, design rights, trade mark rights, database rights and other intellectual property laws in the United Kingdom and internationally.

9.2 Trade marks
“The Foil Edit”, our logo and our product and collection names are trade marks of The Foil Edit, whether registered or unregistered. You must not use them, or any confusingly similar name, logo or branding, without our prior written permission. This includes use in business names, domain names, social media accounts, marketplace listings, hashtags, advertising or search engine keywords.

9.3 What you may do
You may view, download and print pages from our website for your own personal, non-commercial use only, such as to browse products or place an order.

9.4 What you must not do
Without our prior written permission, you must not:

• (a) copy, reproduce, download, screenshot or reuse our product photographs, videos or images for any purpose other than personal reference;
• (b) copy, rewrite, paraphrase or closely imitate our product descriptions, guides or other written content;
• (c) reproduce or imitate our product designs, packaging, branding or website design;
• (d) use our images, content or branding on any website, online marketplace (such as Etsy, Amazon, eBay, Temu or TikTok Shop), social media platform or printed material;
• (e) present our products, images or content as your own, or suggest any connection with, or endorsement by, The Foil Edit where none exists;
• (f) scrape, harvest or extract content or data from the Services by automated means, or use any of our content to train, develop or prompt artificial intelligence or machine learning systems; or
• (g) remove or alter any copyright notice, watermark or other identifying mark.

9.5 Enforcement
We actively monitor for unauthorised use of our intellectual property and take infringement seriously. If we discover infringement, we may, without further notice:

• (a) submit takedown and infringement reports to online marketplaces, social media platforms, hosting providers, domain registrars and search engines;
• (b) issue formal cease and desist demands; and
• (c) bring legal proceedings. In those proceedings we may seek injunctions, damages or an account of profits, the delivery up or destruction of infringing materials, and our legal costs.

9.6 Reporting infringement
If you see our products, images, content or branding being used without permission, please let us know at hello@thefoiledit.co.uk with a link or screenshot. We appreciate your help.

9.7 Licensing enquiries
If you would like to use any of our content, for example for press, collaboration or wholesale purposes, please contact us at hello@thefoiledit.co.uk. Permission must be given in writing.

The Foil Edit is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with The Foil Edit. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Foil Edit, and you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with The Foil Edit.

SECTION 13 - PRIVACY AND DATA PROTECTION

If an error affects an order you have placed, we will contact you. If the order is cancelled as a result, we will refund any amount you have paid in full.

You will remain liable for all amounts due up to and including the date of termination. Termination will not affect any order we have already accepted or your statutory rights in relation to it.

The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy and any other provisions that by their nature should survive termination.

We supply products for domestic and private use only. If you use the products for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
